Ennek a weboldalnak az üzemeltetője Zsadon Ferencné egyéni vállalkozó (továbbiakban: Pastello). Azzal, hogy vásárlónk meglátogatja az oldalunkat és/vagy vásárol tőlünk a webáruházunkon keresztül, automatikusan elfogadja az Általános Szerződési Feltételeinket (ÁSZF). Az alábbi feltételek kizárólag azon vásárlóinkra vonatkoznak, akik értékesítési felületünkön keresztül fizetik ki rendeléseiket. A webáruház használatával a vásárló kijelenti, hogy egyetért az Általános Szerződési és Felhasználási Feltételek tartalmával.

Minden kedves vásárlónkat arra kérjük, vásárlás előtt olvassa el az Általános Szerződési Feltételeinket, mivel a honlapunk bárminemű használata során ezek vonatkoznak rájuk. Amennyiben a vásárlónk nem ért egyet a szerződésben foglaltakkal, arra kérjük, ne vegye igénybe online szolgáltatásunkat.

1.2.  E-számlázás

A Pastello a 2007. évi CXXVII. törvény 175. §. szerinti elektromos számlát alkalmaz. Ön a jelen ÁSZF elfogadásával beleegyezését adja az elektronikus számla alkalmazásához.

1.3 Számla típusa

Kizárólag ÁFA bélküli AAM számlát tudunk adni.

2. Az online shop használatának általános feltételei

2.1. Az online áruházat csak a 18. életévüket betöltött személyek használhatják.

2.2. A 18. életévüket be nem töltött személyeknek az online bolt használatához a szülő vagy törvényes képviselő (gyám) hozzájárulása szükséges.

2.3. Vásárló alatt értjük valamennyi természetes és jogi személyt, valamint a jogi személyiséggel nem rendelkező jogalanyokat. A Vásárló fogalma magában foglalja a fogyasztó fogalmát. A Ptk. 8:1:3 pontja értelmében fogyasztó a szakmája, önálló foglalkozása vagy üzleti tevékenysége körén kívül eljáró természetes személy.

2.4. Amennyiben regisztrál nálunk, akkor személyes adatokat továbbít. Adatainak feldolgozásához hozzájárulására van szükségünk, ennek hiányában sajnos nem használhatja az online áruházat. Adatai feldolgozásának típusát és módját az alábbiakban ismertetjük: Adatkezelési tájékoztató

2.5. Az online shopban megvételre kínált termékek értékesítése kizárólag fogyasztónak minősülő Vásárlók és gazdasági társaságok, mint végfelhasználók részére történik. Az áruk értékesítése csak személyes használatra megfelelő mennyiségekben történik. A termékek kereskedelmi újra, illetve továbbértékesítése nem engedélyezett. Az Pastello ebből következően fenntartja a jogot arra, hogy ne fogadjon el olyan szerződéses ajánlatot, amelynél gyanú merül fel arra vonatkozóan, hogy kereskedelmi újra, illetve továbbértékesítés céljából történt az ajánlattétel.

2.6. Az Eladó online boltja csak egy értékesítési katalógus. Azzal, hogy a termékek megjelennek az online shopban, az eladó csak arra hívja a Vásárlót, hogy tegyen ajánlatot a bemutatott termékekre és kössön adásvételi szerződést (továbbiakban a „Megrendelés”).

2.7. Bárminemű tájékoztatás, ügyintézés és szerződéskötés, valamint a szavatossági eljárás nyelve a magyar. A szerződés megkötése is kizárólag magyar nyelven történik, arra Magyarország joga az irányadó.

2.8.  Az online bolt használatával kötött szerződés nem minősül írásba foglalt szerződésnek. Jogi szempontból az online shopban leadott megrendelések ráutaló magatartás formájában tett jognyilatkozatnak minősülnek.

3.  Személyes adatainak feldolgozása

3.1. A személyes adatainak feldolgozásához adott beleegyezése önkéntes. Meg kell azonban jegyeznünk, hogy amennyiben nem járul hozzá ehhez a feldolgozáshoz, akkor a regisztráció és az online shop használata nem lehetséges. Az adatvédelemmel kapcsolatos minden egyéb információt az Adatkezelési Tájékozatatóban talál.

3.2. Bizonyos esetekben hozzájárulását kérjük online boltunkban, hogy hirdetéseket pl. speciális ajánlatokat, akciókat stb. küldjünk Önnek. Az Ön hozzájárulása önkéntes és bármikor visszavonható. Részletesebben az Adatkezelési Tájékoztatóban olvashat erről.

4. Megrendelések

A megrendelések leadása a http://pastelloclothes.com oldalon történik.

4.1. A termékkel kapcsolatos fontos tudnivalókat (így különösen azok lényeges tulajdonságai, jellemzői: méret, szín, alapanyag) valamint az eladási árakat a Vásárló a termék információs oldalán ismerheti meg még a megrendelése leadása előtt.

4.2. A megrendelés során Ön kiválasztja a méretet, a mennyiséget és az egyéb szükséges jellemzőket.

5. online bolt – hasznos vásárlási információk

5.1. A termékválasztékból kiválasztott terméket a „Hozzáadás a kosárhoz” gombra kattintva az online bevásárló kosárba helyezi. Ezzel még nem vállal kötelezettséget.

5.2. A bevásárló kosárba helyezett tételeket a weboldal felső részén lévő „Bevásárló kosár” gombra kattintva megtekintheti. Itt ki is törölhet tételeket, vagy megváltoztathatja egy adott tétel darabszámát.

5.3. Ha meg szeretné vásárolni a bevásárló kosárban lévő termékeket, kattintson a „Megrendelés” vagy “Go to Checkout”  gombra.

5.4. Az „Apply” gombra kattintva Ön egy kötelező érvényű és fizetési kötelezettséggel járó ajánlatot tesz a bevásárló kosarában lévő termékek megvásárlására, egyúttal elfogadja és magára nézve kötelezőnek ismeri el a jelen ÁSZF-et és az Adatvédelmi Szabályzatot.

5.5. Vásárlóként elállási joga van a jelen ÁSZF 9. pontja alapján, amit a fenti művelet nem befolyásol.

5.6. Ön visszaléphet a megrendeléstől a megrendelési folyamat alatt egészen a fizetésig. Ehhez elegendő, ha nem tesz további lépéseket és elhagyja a megrendelési oldalt.

5.7. A Vásárló részéről a megrendelés leadása nem eredményezi az Pastello és a Vásárló közötti szerződés létrejöttét. A megrendelés megérkezése után az Eladó megerősítő e-mailt küld, amely tartalmazza rendelése részleteit, melynek tartalmát Vásárló köteles ellenőrizni. Ez még nem jelenti az adásvételi szerződés létrejöttét. Ez a visszaigazoló email kizárólag arról tájékoztatja a Vásárlót, hogy a megrendelés megérkezett. A szerződés csak akkor tekinthető megkötött szerződésnek, amikor az Pastello kinyilvánítja a rendelés elfogadását, ami a szállítás megerősítésének elküldésével jön létre.

5.8. Az Eladó telefonon megkeresheti Önt (ha megadott egy telefonszámot), vagy e-mailben kapcsolatba léphet Önnel, hogy tisztázza a megrendeléssel és a szállítással kapcsolatos nyitott kérdéseket. A telefonszámokat és az e-mail címeket csak a megrendelés feldolgozásához és a szállításhoz használjuk, ezeket promóciós célokra, az Ön kifejezett hozzájárulása nélkül nem vesszük igénybe. 

6. Árak

6.1. Az online boltban megadott valamennyi ár forintban értendő és tartalmazza a törvényes általános forgalmi adót (bruttó ár). A szállítási költség összege a kiválasztott szállítási és fizetési opciótól függ. Ezeket a költségeket külön számolják fel. A megrendelés leadása előtt az ár, beleértve az általános forgalmi adót és a felmerült szállítási költségeket, ismét megjelenik.

6.2. A megrendelés végén feltüntetett vételárak mindig végleges eladási árak. Ezt követően az ár már nem fog változni, akkor sem, ha az Eladó az áruk árát később növeli, vagy csökkenti.

6.3. Eladó fenntartja magának a jogot a jelenlegi törvények keretén belül az online bolt árainak változtatására, új termékek ajánlására és engedmények kínálására vagy megvonására. 

6.4. Hibás/téves árfeltüntetés

Amennyiben az Pastello minden gondossága és körültekintése ellenére hibás ár kerül feltüntetésre az online shopban, akkor a Pastello nem köteles a terméket hibás áron értékesíteni, hanem felajánlhatja Vásárlónak a helyes és tényleges áron történő teljesítését, amelynek ismeretében a Vásárló elállhat vásárlási szándékától.

Hibás árnak minősül különösen, de nem kizárólagosan:

–      nyilvánvalóan téves, irreális ár, ami az érintett termék közismert, általánosan elfogadott árától jelentősen eltér;

–      esetleg rendszerhiba miatt megjelenő „0” Ft-os vagy „1” Ft-os ár;

–      egyéb feltűnő értékaránytalanságot mutató ár

7. A szállítási típusa és ideje

7.1. A megrendelt termékeket csak Magyarország területén szállítjuk ki.

7.2. Az Ön által megadott szállítási címre történő szállításon kívül személyes átvétel is lehetséges. Budapest II. kerület Varsányi Irén utcában.

7.3. A szállítási idő rendszerint 10-15 munkanap. Hétfőtől péntekig, munkanapokon szállítjuk a megrendeléseket; ez azt jelenti, hogy a szombat és a vasárnap, ünnepnap nincs beleszámítva a szállítási időbe. A szállítási időszak a szállítás megerősítésének napján kezdődik. Kapcsolatba lépünk Önnel, ha valamelyik tétel valamilyen oknál fogva már nem kapható, vagy nem tudjuk küldeni. Ebben az esetben a termék árának visszafizetéséről haladéktalanul intézkedünk, amennyiben azt a vásárló már korábban kifizette.

8. Fizetési módok:

Az alábbi fizetési lehetőségek állnak a rendelkezésére: banki átutalás és bankkártyás fizetés.

Ha banki átutalás választ , akkor a megrendelés időpontja a számla teljes összegének megérkezése. A fent említett szállítási időszak csak ekkor indul.

Bankkártyás fizetés esetén a visszaigazoláskor.

A fizetés során beírt adatokat az Pastello nem tárolja, azokat az adott fizetéskezelő cég kezeli és a pénzügyi szolgáltatók eltérő adatvédelmi rendelkezései lépnek érvénybe ezen esetekben.

Figyelem! Soha nem küldünk emailben értesítést bankszámla változásról és hogy pénzátutalással rendezze a vételárat. Ilyen üzeneteket ne vegyen figyelembe és ne kezdeményezzen ilyen fizetést. Ilyen esetekben kérjük az alábbi címre küldje át a kapott e-mailt: pastellocolours@gmail.com.

9. Elállási politika

9.1. Jogszabályon alapuló elállási jog

Ha a Vásárló fogyasztónak minősül, megilleti az elállás joga a távollevők között kötött szerződésekről szóló 45/2014. (II. 26.) Kormányrendelet 20. §-a értelmében az online boltban vásárolt termékek tekintetében. Tizennégy naptári napon belül Ön jogosult elállni a szerződéstől anélkül, hogy ezt megindokolná. Ez a tizennégy napos elállási idő azon a napon kezdődik, amikor Önnek vagy egy Ön által megnevezett harmadik félnek, aki nem a szállítmányozó, a termék a birtokába kerül. Elállási jogának gyakorlásához tájékoztatnia kell minket, az alábbi telefonon: +36 30 2133826, vagy a  pastellocolours@gmail.com e-mail címen, egy egyértelmű nyilatkozat útján (e-mailben megküldött levél), hogy úgy döntött, hogy eláll a szerződéstől.

9.2. Az elállás

Elállási jogának gyakorlásához tájékoztatnia kell minket, az alábbi telefonon: +36 30 2133826, vagy a  pastellocolours@gmail.com e-mail címen, egy egyértelmű nyilatkozat útján (e-mailben megküldött levél), hogy úgy döntött, hogy eláll a szerződéstől.

Kérjük mellékelje a megrendelés visszaigazoló emailjét, illetve a számlát, illetve jelölje melyik termék(ek)ről van szó.

Ha eláll a szerződéstől, visszatérítjük a megrendelés értékét, beleértve rendelés kiszállításához kapcsolódó szállítási költségeket is (kivéve azokat a plusz költségeket, ami abból adódott, hogy Ön az általunk kínált legolcsóbb szállítási költségtől eltérő szállítási opciót választott a termék visszaküldéséhez). A szállítási költség abban az esetben kerül visszatérítésre, ha a rendelésben lévő valamennyi termék visszavételre illetve visszaküldésre kerül.

A visszafizetés minden esetben bankszámlára történő visszautalással történik legfeljebb 14 napon belül. A Pastello visszatarthatja a visszatérítést addig, amíg az áru megérkezik, vagy amíg Ön nem bizonyítja, hogy az árut visszaküldte részünkre – attól függően, melyik esemény a korábbi.

A fogyasztónak minősülő Vásárló elállás esetén köteles a megrendelt terméket késedelem nélkül, de legkésőbb elállási nyilatkozatának közlésétől számított 14 (tizennégy) napon belül az Pastello részére visszaküldeni.

A Pastello-nak a fenti címtől eltérő helyre, illetve utánvéttel visszaküldött csomagot nem áll módjában átvenni. A termék visszaküldési költségén kívül az elállás kapcsán a Vásárlót semmilyen más költség nem terheli.

Abban az esetben, ha a fogyasztónak minősülő Vásárló a termék megvásárlására irányuló szerződéstől egyoldalú nyilatkozattal eláll, azonban az elállással érintett terméket annak jellege, tulajdonságai, illetve működése megállapításához szükséges használatot meghaladó mértékben használta, a termékben bekövetkező értékcsökkenésért felelősséggel tartozik.

10. Szavatosság

10.1. A megvásárolt termékek hibái kapcsán az alábbi szavatossági igényt jelenthet be a Magyar Polgári Törvénykönyv (Ptk.) XXIV fejezete szerint.

Kellékszavatosság

A fogyasztónak minősülő Vásárló az Pastello hibás teljesítése esetén az Pastello-vel szemben kellékszavatossági igényt érvényesíthet. Fogyasztói szerződés esetén a fogyasztónak minősülő Vásárló az átvétel időpontjától számított 2 éves elévülési határidő alatt érvényesítheti szavatossági igényeit, azokért a termékhibákért, amelyek a termék átadása időpontjában már léteztek. Két éves elévülési határidőn túl kellékszavatossági jogait a fogyasztónak minősülő Vásárló érvényesíteni már nem tudja.

A Vásárló – választása szerint – kérhet kijavítást vagy kicserélést, kivéve, ha az ezek közül a Vásárló által választott igény teljesítése lehetetlen vagy az Pastello számára más igénye teljesítéséhez képest aránytalan többletköltséggel járna. Ha a kijavítást vagy a kicserélést a Vásárló nem kérte, illetve nem kérhette, úgy igényelheti az ellenszolgáltatás arányos leszállítását vagy a hibát a Pastello költségére a Vásárló is kijavíthatja, illetve mással kijavíttathatja vagy – végső esetben – a szerződéstől is elállhat. Jelentéktelen hiba miatt elállásnak nincs helye.

A Vásárló a választott kellékszavatossági jogáról egy másikra is áttérhet, az áttérés költségét azonban köteles viselni, kivéve, ha az indokolt volt, vagy arra az Pastello adott okot.

A Vásárló köteles a hibát annak felfedezése után haladéktalanul, de nem később, mint a hiba felfedezésétől számított kettő hónapon belül közölni a Pastello-val.

A Vásárló közvetlenül a Pastello-vel szemben érvényesítheti kellékszavatossági igényét.

A szerződés teljesítésétől számított hat hónapon belül a kellékszavatossági igénye érvényesítésének a hiba közlésén túl nincs egyéb feltétele, ha a Vásárló igazolja, hogy a terméket a Pastello-től vásárolta (nyugta vagy számla bemutatásával). Ilyen esetben a Pastello csak akkor mentesül a szavatosság alól, ha bizonyítja, hogy a termék hibája a Vásárló részére történő átadást követően keletkezett. Amennyiben az Pastello bizonyítani tudja, hogy a hiba oka a Vásárlónak felróható okból keletkezett, nem köteles a Vásárló által támasztott szavatossági igénynek helyt adni. A teljesítéstől számított hat hónap eltelte után azonban már a Vásárló köteles bizonyítani, hogy az általa felismert hiba már a teljesítés időpontjában is megvolt.

Termékszavatosság

Amennyiben hibás a termék Ön – választása szerint – a fenti kellékszavatossági igényét vagy termékszavatossági igényt érvényesíthet.

Termékszavatossági igényként Ön kizárólag a hibás termék kijavítását vagy kicserélését kérheti a termék gyártó általi forgalomba hozatalától számított két éven belül. E határidő elteltével e jogosultságát elveszti. A fogyasztónak minősülő Vásárló a hiba felfedezése után késedelem nélkül köteles a hibát a gyártóval közölni. A hiba felfedezésétől számított két hónapon belül közölt hibát késedelem nélkül közöltnek kell tekinteni. A közlés késedelméből eredő kárért a fogyasztó felelős.

A termék akkor hibás, ha az nem felel meg a forgalomba hozatalakor hatályos minőségi követelményeknek vagy pedig, ha nem rendelkezik a gyártó által adott leírásban szereplő tulajdonságokkal.

Termékszavatossági igényét kizárólag a termék gyártójával vagy forgalmazójával szemben gyakorolhatja.

A gyártó (forgalmazó) kizárólag akkor mentesül termékszavatossági kötelezettsége alól, ha bizonyítani tudja, hogy:

– a terméket nem üzleti tevékenysége körében gyártotta, illetve hozta forgalomba, vagy

– a hiba a tudomány és a technika állása szerint a forgalomba hozatal időpontjában nem volt felismerhető vagy

– a termék hibája jogszabály vagy kötelező hatósági előírás alkalmazásából ered.

A gyártónak (forgalmazónak) a mentesüléshez elegendő egy okot bizonyítania.

Felhívjuk figyelmét, hogy ugyanazon hiba miatt kellékszavatossági és termékszavatossági igényt egyszerre, egymással párhuzamosan nem érvényesíthet. Termékszavatossági igényének eredményes érvényesítése esetén azonban a kicserélt termékre, illetve kijavított részre vonatkozó kellékszavatossági igényét a gyártóval szemben érvényesítheti.

10.2. Abban az esetben, ha mennyiségi vagy minőségi kifogása van, szíveskedjen ügyfélszolgálatunknak bejelenteni reklamációját. Kérjük, adja meg a rendelési számot, nevét, címét és panasza rövid okát, ha szavatossági igénnyel él. E-mailben küldje meg igényét (pastellocolours@gmail.com). Ezt követően felvesszük önnel a kapcsolatot. Ezután küldje az árut a következő címre: Zsadün Ferencné EV. 2700 Cegléd Közép út 34.

10.3 A nem rendeltetésszerűen használt termékre – azaz a termék mosási, ápolási útmutatótól eltérő használat esetén és az anyag természetes esetleges kopására/fakulására/bolyhosodására – a szavatosság nem vonatkozik. Ebben az esetben cserére és/vagy javításra nincs lehetőség.

10.4 Szavatossági igény esetén mi viseljük a visszaküldés piaci árú, nem expressz költségeit Magyarországról. Egyéb esetben a Vásárlónak kell viselnie a költségeket.

11. Vonatkozó törvény és a bíráskodás helye

11.1. Az Eladó és a Vásárló közötti minden szerződésre Magyarország törvényei vonatkoznak.

12. Szerzői jogok

A szerzői jogról szóló 1999. évi LXXVI. törvény (továbbiakban: Szjt.) 1. § (1) bekezdése értelmében a weboldal szerzői műnek minősül, így annak minden része szerzői jogi védelem alatt áll. Az Szjt. 16. § (1) bekezdése alapján tilos a weboldalon található grafikai és szoftveres megoldások, számítógépi programalkotások engedély nélküli felhasználása, illetve bármely olyan alkalmazás használata, amellyel a weboldal, vagy annak bármely része módosítható. A weboldalról és annak adatbázisából bármilyen anyagot átvenni a jogtulajdonos írásos hozzájárulása esetén is csak a  weboldalra való hivatkozással, forrás feltüntetésével lehet. 13. Jelen ÁSZF változtatása

Eladó jogosult jelen ÁSZF-et egyoldalúan módosítani, ha erre szükség van a jogi vagy technikai keretek változása miatt. Múltbani rendeléseket nem érinti a változás.

The following conditions apply exclusively to our customers who pay for their orders through our sales interface. By using the webshop, the customer declares that they agree to the content of the General Terms and Conditions and Terms of Use.

We ask all our dear customers to read our General Terms and Conditions before purchasing, as they apply to them during any use of our website. If our customer does not agree with the terms of the contract, we ask that they do not use our online service.

2. General conditions for using the online shop

2.1. The online shop may only be used by persons over the age of 18.

2.2. Persons under the age of 18 must have the consent of their parents or legal representatives (guardians) to use the online store.

2.3. By Customer we mean all natural and legal persons, as well as legal entities without legal personality. The concept of Customer includes the concept of consumer. According to Section 8:1:3 of the Civil Code, a consumer is a natural person acting outside the scope of his profession, independent occupation or business activity.

2.4. If you register with us, you transmit personal data. We need your consent to process your data, otherwise, unfortunately, you cannot use the online store. The type and method of processing your data are described below: Data processing information

2.5. The products offered for purchase in the online store are sold exclusively to Customers who are consumers and business entities as end users. The goods are sold only in quantities suitable for personal use. The commercial resale or resale of the products is not permitted. Pastello therefore reserves the right not to accept any contractual offer that is suspected of being made for commercial resale or resale.

2.6. The Seller’s online shop is only a sales catalog. By displaying the products in the online shop, the Seller only invites the Buyer to place an offer for the presented products and conclude a purchase contract (hereinafter referred to as the “Order”).

2.7. The language of any information, administration and conclusion of the contract, as well as the warranty procedure, is Hungarian. The conclusion of the contract is also exclusively in Hungarian, and the law of Hungary is applicable to it.

2.8. A contract concluded using the online shop does not qualify as a written contract. From a legal point of view, orders placed in the online shop are considered a legal statement made in the form of a referral.

4.1. The Buyer can find out important information about the product (in particular its essential properties, characteristics: size, color, material) and sales prices on the product information page before placing his order.

4.2. When ordering, you select the size, quantity and other necessary characteristics.

5. online shop – useful shopping information

5.1. By clicking on the “Add to cart” button, you place the product selected from the product range in the online shopping cart. This does not yet constitute an obligation.

5.2. You can view the items placed in the shopping cart by clicking on the “Shopping cart” button at the top of the website. Here you can also delete items or change the quantity of a given item.

5.3. If you wish to purchase the products in your shopping cart, click on the “Order” or “Go to Checkout” button.

5.4. By clicking on the “Apply” button, you make a binding offer to purchase the products in your shopping cart, and you accept and agree to be bound by these GTC and the Privacy Policy.

5.5. As a customer, you have a right of withdrawal pursuant to Section 9 of these GTC, which is not affected by the above action.

5.6. You may withdraw from the order during the ordering process up to and including payment. To do this, it is sufficient to take no further steps and leave the ordering page.

5.7. Placing an order by the Customer does not result in the conclusion of a contract between Pastello and the Customer. After receipt of the order, the Seller will send a confirmation email containing the details of the order, the content of which the Buyer is obliged to check. This does not yet constitute the conclusion of a sales contract. This confirmation email only informs the Buyer that the order has been received. The contract is only considered concluded when Pastello declares acceptance of the order, which is concluded by sending a confirmation of delivery.

5.8. The Seller may contact you by phone (if you have provided a phone number) or by email to clarify open questions regarding the order and delivery. Phone numbers and email addresses are used only for order processing and delivery, they are not used for promotional purposes without your express consent.

6. Prices

6.1. All prices given in the online store are in HUF and include the statutory value added tax (gross price). The amount of the shipping cost depends on the selected shipping and payment option. These costs are charged separately. Before placing the order, the price, including VAT and the shipping costs incurred, will be displayed again.

6.2. The purchase prices indicated at the end of the order are always final selling prices. After that, the price will not change, even if the Seller subsequently increases or decreases the price of the goods.

6.3. The Seller reserves the right, within the framework of current legislation, to change the prices of the online store, to offer new products and to offer or withdraw discounts.

6.4. Incorrect/incorrect price display

If, despite all the care and caution of Pastello, an incorrect price is displayed in the online shop, Pastello is not obliged to sell the product at an incorrect price, but may offer the Customer the correct and actual price, in the knowledge of which the Customer may withdraw from his intention to purchase.

An incorrect price is considered in particular, but not exclusively:

–      an obviously incorrect, unrealistic price, which significantly differs from the well-known, generally accepted price of the product concerned;

–      a price of “0” HUF or “1” HUF that may appear due to a system error;

–      other price showing a striking disproportionality

7. Type and time of delivery

7.1. The ordered products are only delivered within Hungary.

7.2. In addition to delivery to the delivery address you have provided, personal collection is also possible. Budapest II. District Varsányi Irén Street.

7.3. The delivery time is usually 10-15 working days. We ship orders on working days from Monday to Friday; this means that Saturdays, Sundays and public holidays are not included in the delivery time. The delivery period starts on the day of confirmation of delivery. We will contact you if an item is no longer available for any reason or we cannot send it. In this case, we will immediately arrange for a refund of the price of the product, if the buyer has already paid for it.

8. Payment methods:

The following payment options are available to you: bank transfer and credit card payment.

If you choose bank transfer, the order is placed when the full amount of the invoice is received. The delivery period mentioned above only starts at that time.

In the case of credit card payment, upon confirmation.

The data entered during the payment is not stored by Pastello, it is processed by the respective payment processing company and different data protection provisions of financial service providers apply in these cases.

Attention! We never send email notifications about bank account changes and to settle the purchase price by money transfer. Do not take such messages into account and do not initiate such payments. In such cases, please forward the received email to the following address: pastellocolours@gmail.com.

9. Withdrawal Policy

9.1. Right of withdrawal based on legal provisions

If the Buyer is a consumer, he has the right of withdrawal in accordance with Article 20 of Government Decree 45/2014. (II. 26.) on distance contracts for products purchased in the online store. You have the right to withdraw from the contract within fourteen calendar days without giving any reason. This fourteen-day withdrawal period begins on the day on which you or a third party named by you, who is not the carrier, acquires physical possession of the product. To exercise your right of withdrawal, you must inform us by telephone at +36 30 2133826 or by email at pastellocolours@gmail.com, by means of a clear statement (letter sent by email) that you have decided to withdraw from the contract.

9.2. Withdrawal

To exercise your right of withdrawal, you must inform us by a clear statement (letter sent by e-mail) that you have decided to withdraw from the contract by calling +36 30 2133826 or by sending an e-mail to pastellocolours@gmail.com.

Please enclose the order confirmation email or invoice and indicate which product(s) are concerned.

If you withdraw from the contract, we will refund the value of the order, including the delivery costs associated with the delivery of the order (except for the additional costs resulting from the fact that you have chosen a delivery option other than the cheapest delivery cost offered by us for the return of the product). The delivery costs will be refunded if all products in the order are returned or exchanged.

In all cases, the refund will be made by bank transfer to a bank account within a maximum of 14 days. Pastello may withhold the refund until the goods have arrived or until you have proven that you have returned the goods to us – whichever is the earlier.

In the event of withdrawal, the Customer, who is a consumer, is obliged to return the ordered product to Pastello without delay, but no later than 14 (fourteen) days from the date of notification of his/her withdrawal.

Pastello is unable to accept packages returned to a location other than the above address or by cash on delivery. Apart from the cost of returning the product, the Customer will not be charged any other costs in connection with the withdrawal.

In the event that the Customer, who is a consumer, unilaterally withdraws from the contract for the purchase of the product, but has used the product affected by the withdrawal to an extent exceeding the use necessary to establish its nature, properties or operation, he is liable for any depreciation in the product.

10. Warranty

10.1. In connection with defects in the purchased products, the following warranty claim may be filed in accordance with Chapter XXIV of the Hungarian Civil Code (Ptk.).

Warranty

The Customer, who is a consumer, may assert a warranty claim against Pastello in the event of defective performance by Pastello. In the case of a consumer contract, the Customer, who is a consumer, may assert his warranty claims within a 2-year limitation period from the date of receipt for product defects that already existed at the time of delivery of the product. Beyond the two-year limitation period, the Customer, who is a consumer, can no longer assert his warranty rights.

The Customer may – at his choice – request repair or replacement, unless the fulfillment of the claim chosen by the Customer from these is impossible or would entail disproportionate additional costs for Pastello compared to the fulfillment of his other claim. If the Customer did not or could not request the repair or replacement, the Customer may request a proportional reduction in the consideration or the Customer may repair the defect at Pastello’s expense or have it repaired by someone else or – as a last resort – may withdraw from the contract. There is no right to withdraw due to an insignificant defect.

The Customer may also switch from the chosen warranty right to another, but must bear the cost of the switch, unless this was justified or Pastello gave reason for it.

The Customer is obliged to notify Pastello of the defect immediately after its discovery, but no later than within two months of its discovery.

The Customer may assert its warranty claim directly against Pastello.

Within six months of the performance of the contract, there is no other condition for asserting a warranty claim other than notification of the defect, if the Buyer proves that the product was purchased from Pastello (by presenting a receipt or invoice). In such a case, Pastello is only exempt from the warranty if it proves that the defect in the product arose after it was handed over to the Buyer. If Pastello can prove that the cause of the defect arose for a reason attributable to the Buyer, it is not obliged to grant the warranty claim made by the Buyer. However, after six months from the performance, the Buyer is obliged to prove that the defect he has recognized already existed at the time of performance.

Product Warranty

If the product is defective, you can – at your choice – assert the above warranty claim or a product warranty claim.

As a product warranty claim, you can only request the repair or replacement of the defective product within two years from the date the product was placed on the market by the manufacturer. After this period, you will lose this right. The Buyer, who is a consumer, is obliged to notify the manufacturer of the defect without delay after discovering the defect. A defect notified within two months of discovering the defect shall be deemed to have been notified without delay. The consumer is liable for damage resulting from the delay in notification.

A product is defective if it does not meet the quality requirements in force at the time of its placement on the market or if it does not have the properties specified in the description given by the manufacturer.

You can only exercise your product warranty claim against the manufacturer or distributor of the product.

The manufacturer (distributor) is only exempt from its product warranty obligation if it can prove that:

• the product was not manufactured or placed on the market as part of its business activities, or
• the defect was not recognizable at the time of placing on the market according to the state of science and technology, or
• the product defect results from the application of a law or a mandatory official regulation.

The manufacturer (distributor) only needs to prove one reason to be exempted.

Please note that you cannot assert a warranty claim and a product warranty claim simultaneously and in parallel due to the same defect. However, if your product warranty claim is successfully asserted, you may assert a warranty claim against the manufacturer for the replaced product or repaired part.

10.2. If you have a quantitative or qualitative complaint, please report your complaint to our customer service. Please provide your order number, name, address and a brief reason for your complaint if you have a warranty claim. Send your claim by e-mail (pastellocolours@gmail.com). We will then contact you. 10.3 The warranty does not apply to products that are not used for their intended purpose – i.e. if the product is used in a way that deviates from the washing and care instructions and if the material naturally wears out/fades/pilling. In this case, there is no possibility of replacement and/or repair.

10.4 In the event of a warranty claim, we will bear the market price, non-express costs of the return from Hungary. In other cases, the Buyer must bear the costs.

11. Applicable law and place of jurisdiction

11.1. All contracts between the Seller and the Buyer are subject to the laws of Hungary.

12. Copyright

According to Section 1 (1) of the Copyright Act LXXVI of 1999 (hereinafter: the Copyright Act), the website is considered a work of authorship, so all parts of it are protected by copyright. Pursuant to Section 16 (1) of the Copyright Act, the unauthorized use of graphic and software solutions, computer programs on the website, or the use of any application with which the website or any part of it can be modified is prohibited. Any material from the website and its database may only be taken over with the written consent of the copyright owner, with a reference to the website and indicating the source. 13. Changes to these GTC

The Seller is entitled to unilaterally modify these GTC if this is necessary due to changes in the legal or technical framework. Past orders are not affected by this change.
